KaZuum does not claim ownership of user content, but if you post text, graphics, logos, trademarks, photos, videos, sounds, works of arts or any intellectual properties (collectively referred as “Content”), on the website, you give KaZuum a non-exclusive irrevocable world-wide license to use, replicate, excerpt and display your Content in connection with our site or other sites to promote KaZuum. By posting any Content on this website, you represent and warrant that you own the said Contents, and license the Contents to us free of charges or loyalty. You understand that KaZuum is not responsible for Contents posted in our service or job postings, forums, and user blogs or profiles, and by viewing such Contents, you may be exposed to offensive, vulgar, questionable, inaccurate and misleading Contents. Please report offending users immediately

You agree that you would not copy, modify, or distribute contents from KaZuum without our permission. You may not disassemble or decompile, reverse engineer or otherwise attempt to discover any source code or trade secrets contained in KaZuum.

4. Rights to Suspend or Terminate

You agree that this website, in its own discretion, may terminate any postings by users or uses of the service immediately and without notice if (a) we believe that you are not abiding by the general rules of this website, (b) you have repeatedly broken a certain term, (c) you have posted a suspicious listing that might be in violation of law, (d) we believe you to be a non-paying bidder, (e) we believe you are a non-performing seller, (f) performance of service may be in violation of intellectual property laws, (g) attempt to manipulate our auction, project system, (h) engage in distribution of spam or schemes to our members, (i) collect personal data for unlawful usage, (j) stalk or harass other users, (k) engage in disruptive behaviors, (l) replicate, revise, and distribute contents created by other users without their consent. In most cases when we suspect foul play we will suspend your account/listing whilst we investigate further. If our investigation is conclusive then your account with us will be terminated.

5. Your Conduct.

You are solely responsible for the contents of your actions through this website. You must ensure that your participation in the selling or buying of services does not violate any applicable laws or regulations. By this we mean that you must check that you entitled and qualified to sell services and that you are not prohibited from doing so by any law or regulation.

You must not transmit through the site any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation. You must also make sure you do not violate any intellectual laws when you perform your services.

6. Rights of Usage

You agree not to do the following 1) Copy, modify, translate, reverse engineer, reformat or frame in part or whole of KaZuum site and its features. 2) Remove copyright or trademark related materials obtained from KaZuum Site. 3) Use robots, spider, site search application or other automated means to index or reconstruct KaZuum listings, reviews, or any contents within KaZuum site. 4) Collect information from users for purpose other than usage related to KaZuum site. 5) Create user account under false pretenses or automatic means. 6) Transmit and broadcast virus, worms, trojans, exploit programs and other softwares that cause disruption on site. 7) Gather information for the purpose of creating spams. 8) Intentionally take actions that will use up abnormally large amount of our system resources.

7. Blogs & Forums

We provide users access to our Blogs and Forums features to post their opinions on. We expect people to post their personal works and opinions, but we expect users to follow “Your Conducts” listed above.

Users should be aware of intellectual property laws when posting from outside sources, and we reserve the right to report offending users to proper authorities.

8. Membership

Legal contracts in the auctions may be only be formed with an adult, please be aware of this if you choose to buy services from a minor member, as your contract may not be enforceable in a court of law.

9. Personal Information

KaZuum may collect, transfer, store user information on its servers located in U.S. for internal use and user information will not be shared with any other entities. You may also receive newsletters from us unless you decide to opt out. Please refer to our Privacy Policy for more details.

10. Transactions

This site provides classified listing of services. We provide the quote exchange platform for buyers and sellers. We are in no way involved in the actual monetary transaction between buyers and sellers. We have no control over the timeliness, performance quality or legality of services listed. Nor do we have control over the truth or accuracy of the listings. We do not guarantee the ability of the service providers to provide any services, nor do we guarantee buyer’s ability to pay. We cannot and do not control whether or not sellers will complete performance of services they offered or buyers will complete the payments of services they have bid on. We should not be held liable for the timely performance of the services. In addition, note that there are risks of dealing with foreign nationals, underage persons or people acting under false pretence. If any local laws are violated, KaZuum will cooperate with appropriate officials in the investigation.

This Website shall not be responsible for any services listed in its auctions or postings, nor for misrepresentations and/or breaches of contract by either buyer and/or seller. This website shall not be responsible for the cost of procurement of substitute services or any losses resulting form any services purchased or obtained. This web-site assumes no liability for the content of the listings. However if you fall victim of a fraudulent transaction we will assist you as much as we can.

By agreeing to those terms, you relieve the site KaZuum.com and its owners, KaZuum, Inc., of any liabilities and damages, be them implicitly or explicitly stated that result from transaction and/or usage of our website. You agree that KaZuum.com and its employees do not assume any legal liabilities for the accuracy, completely, or usefulness of any information, apparatus, products, or process disclosed, or make warranties, be they expressed or implied that are associated with the site.

11. Indemnity

You agree to hold KaZuum, its officers, directors, agents, representatives, employees, contractors, harmless from any liability or loss from any disputes that arises between you and a third party while using our service.

12. Fees

We reserve the right to charge a fee for listing and posting services after trail period, but bidding on listings and opening an account is free. We will notify you of any fee change one month in advance. You are responsible for paying your Site Fees and any taxes and expenses associated with the sale of your services. We reserve the right to freeze or terminate your account after one month of billing if we are not paid with a valid payment method. For account with large unpaid balance, we may resort to collection agency.

13. Service

If there is an interruption of service, due to technical problems with telecommunication networks, computer system, software failure, server or site crashes, and other known or unknown factors that prevent you access to our site and suffer a monetary lost, we should not be held liability beyond refunding your fees paid for the listings prior to the crash. You agree not to hold us liable for personal injuries or death results from using this site or interacting with our users.

14. User Information

In using your KaZuum account, you agree to (a) safeguard your password and login information, (b) keep the information you provided to KaZuum accurate and up to date, (c) take full responsibility for all usage of your account and any account information that are directly linked with KaZuum .We are not liable for any damages as a result of you losing your password to a fraudulent user, but we will assist you to the best of our abilities.

15. Laws

If there is any legal dispute between you and KaZuum, you agree the dispute is to be settled with the laws of the State of California. You agree any dispute you have between KaZuum and you must be settled within a court located within Santa Clara County, California.
